1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of Tulugan, including our website, dashboard, and related services. By creating an account, browsing listings, posting a property, or otherwise using Tulugan, you agree to be bound by these Terms.
These Terms apply to all users, including hosts who list properties and renters who browse listings or send inquiries. If you do not agree to these Terms, you may not use Tulugan.
2. Description of Service
Tulugan is an online marketplace that connects renters with hosts offering bed spaces, rooms, apartments, condos, boarding houses, office spaces, coworking spaces, commercial spaces, and transient or short-term rentals across the Philippines.
Tulugan provides discovery, listing, and communication tools. We are not a party to any rental agreement, lease, or transaction between a host and a renter. We do not process rental payments, hold deposits in escrow, or guarantee the outcome of any rental arrangement. All rental terms, payments, and obligations are agreed directly between hosts and renters.
3. Account Registration
- You must be at least 18 years old to create an account and use Tulugan
- You must provide accurate and current information when registering
- You are responsible for maintaining the security of your account credentials and for all activity under your account
- Each person may maintain only one account unless we expressly authorize otherwise
- You must notify us promptly if you suspect unauthorized access to your account
4. Host Responsibilities
As a host on Tulugan, you agree to:
- Provide accurate listing information, including price, photos, location, amenities, house rules, and availability
- Ensure you have the legal right to offer the property for rent and that the property complies with applicable laws
- Maintain the property in a condition consistent with your listing description
- Honor rental terms agreed directly with renters outside of Tulugan
- Not post false, misleading, duplicate, or fraudulent listings
- Manage your own tenant relationships, rent collection, payments, and disputes independently of Tulugan
- Respond to inquiries in good faith and communicate honestly with prospective renters
Tulugan does not process rental payments or act as an escrow service. Any payment arrangements are made directly between you and the renter.
5. Renter Responsibilities
As a renter using Tulugan, you agree to:
- Provide accurate contact information when sending inquiries
- Verify listing details, property condition, rental terms, and pricing directly with the host before moving in or sending any payment
- Conduct your own due diligence before entering into any rental agreement
- Understand that Tulugan does not guarantee the accuracy of listings or the conduct of hosts
- Use inquiries and communications respectfully and for legitimate rental purposes only
6. Prohibited Conduct
You may not use Tulugan to:
- Post fraudulent, deceptive, or misleading listings or inquiries
- Harass, threaten, or abuse other users
- Scrape, crawl, or use automated tools to access the platform without our written permission
- Attempt to bypass platform security, rate limits, or access controls
- Post listings for illegal rental arrangements or properties you are not authorized to offer
- Impersonate another person or misrepresent your affiliation with a property or organization
- Upload content that infringes third-party intellectual property or privacy rights
We may investigate violations and take action, including removing content or suspending accounts, at our discretion.
7. Featured and Boost Listings
Hosts may pay to feature or boost their listings for increased visibility on Tulugan. Featured and boost placements are paid promotional services. Payment for a boost does not guarantee inquiries, bookings, or rental agreements. Boost activation is subject to our review process after payment confirmation.
8. Content Ownership
Hosts retain ownership of the content they upload to Tulugan, including listing photos, titles, and descriptions. By posting content on Tulugan, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content on the platform and in related marketing materials for the purpose of operating and promoting Tulugan.
You represent that you own or have the necessary rights to all content you upload and that your content does not violate any third-party rights or applicable laws.
9. Limitation of Liability
Tulugan is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Tulugan and its operators disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Tulugan is a discovery and communication platform only. We are not liable for disputes, damages, losses, injuries, or other harm arising from rental arrangements, property conditions, payments, or interactions between hosts and renters, whether online or offline. Your use of Tulugan is at your own risk.
To the maximum extent permitted by applicable law, our total liability to you for any claim arising from your use of Tulugan shall not exceed the amount you paid to Tulugan in the twelve months preceding the claim, or one hundred Philippine pesos (₱100), whichever is greater.
10. Account Termination
You may stop using Tulugan and request account deletion at any time by contacting us. We may suspend or terminate your account, remove listings, or restrict access if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or posed a risk to other users or the platform.
Upon termination, your right to use Tulugan ceases immediately. Provisions that by their nature should survive termination, including content licenses, disclaimers, and limitations of liability, will continue to apply.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of Tulugan after updated Terms are posted constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using Tulugan.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of Tulugan shall be subject to the exclusive jurisdiction of the courts of the Philippines.
